Step-Parent Adoption
Adoptions of the children of a spouse are referred to as “step-parent” adoptions. When a step-parent, with the consent of his or her spouse, wants to adopt the other spouse’s child, a petition must be filed with the Superior Court asking that the adoption be granted. In all cases, the non-custodial parent must either consent or have his/her rights terminated by the court. The rules regarding termination of parental rights is very strict and set forth in the Family Code.
In most cases, even without consent, a court will allow the adoption where there has been abandonment or the child has not received communication or support for more than one year. Every step-parent adoption case is investigated by the County Health and Human Resources agency with a report going to the court. Garry J.
